AGREEMENT TO OUR TERMS

Welcome to 99Plus ("Company," "we," "us," "our"), managed by Infortronix Pvt Ltd, based in Sri Lanka.

We operate the mobile application "99Plus" (the "App"), along with other associated products and services that refer or link to these terms (the "Legal Terms"). Collectively, these offerings are known as the "Services."

99Plus provides a platform where students from grades 5 to 13 can practice exam questions and papers.

By accessing and using our Services, you confirm that you have read, understood, and agree to be bound by these Legal Terms. IF YOU DO NOT AGREE WITH THESE LEGAL TERMS, YOU ARE PROHIBITED FROM USING THE SERVICES AND MUST IMMEDIATELY DISCONTINUE USE.

We may update these Legal Terms from time to time. Any changes will be reflected by updating the "Last Updated" date. It is your responsibility to periodically review these terms to remain informed of any modifications. Your continued use of the Services after the posting of revised Legal Terms signifies your acceptance of those changes.

If you are under the age of 18, you must have your parent or guardian's permission to use the Services, and they must read and agree to these terms on your behalf.

1. SERVICES PROVIDED

The content and services offered by 99Plus are intended for users in jurisdictions where their use does not violate any local laws or regulations. Users accessing our Services from other regions do so at their own discretion and are responsible for complying with any applicable laws.

2. INTELLECTUAL PROPERTY RIGHTS

Ownership of Intellectual Property

We are the sole owners or authorized licensees of all intellectual property in the Services, including but not limited to source code, functionality, software, designs, text, images, and graphics ("Content") as well as any trademarks or service marks ("Marks").

All Content and Marks are protected by intellectual property laws and treaties. You are granted limited, non-commercial use of the Content, and may not exploit or reproduce any part of the Services without express permission.

3. USER OBLIGATIONS

By using 99Plus, you confirm that:

1. All information provided during registration is accurate and up to date.
2. You will maintain the security of your account and password.
3. You are legally able to agree to these terms, and if you are a minor, you have the required parental consent.
4. You will not engage in illegal or unauthorized activities while using the Services.

If any information you provide is false or misleading, we reserve the right to suspend or terminate your account.

4. ACCOUNT REGISTRATION

You may be required to register for an account to access certain features of 99Plus. You agree to maintain the confidentiality of your account and password and are responsible for any activity that occurs under your account.

5. PRODUCTS

All products available on the Services are subject to availability. We reserve the right to discontinue products or change pricing at any time without notice.

6. PAYMENTS AND PURCHASES

We accept payments through bank deposits and payment gateways (details will be provided within the app). You must ensure that all account and payment information is accurate and up to date. All payments are final and non-refundable.

7. REFUND POLICY

All sales made through 99Plus are final, and no refunds will be issued.

8. SOFTWARE

The software included with 99Plus is for personal use only, and you are granted a non-transferable license to use it in accordance with these terms. Any unauthorized reproduction of the software is prohibited.

9. RESTRICTED ACTIVITIES

Users of 99Plus agree not to:

Attempt to reverse-engineer or modify the Services;
Upload or distribute malicious software or viruses;
Collect or harvest user data without consent;
Engage in any activity that may harm the operation of the Services.

10. USER CONTENT

Users may be permitted to upload, post, or share content through 99Plus. By doing so, you grant us a non-exclusive, worldwide, royalty-free license to use, distribute, and display such content.

You are responsible for ensuring that your content does not violate any laws or the rights of others.

11. CONTENT LICENSE

By submitting content to 99Plus, you grant us the right to use, copy, and display your content across the Services. You retain ownership of your content but agree that we may use it as necessary to operate the Services.

12. REVIEW GUIDELINES

Reviews posted on 99Plus should be based on genuine experience. You may not post misleading or defamatory content.

13. MOBILE APP LICENSE

We grant you a limited license to download and use our app for personal use. This license may be revoked at any time if you violate these terms.

14. ADVERTISING

We may allow third-party advertisers to display ads on 99Plus. Advertisers are responsible for ensuring that their ads comply with all relevant laws and regulations.

15. SERVICE ADMINISTRATION

We reserve the right to monitor, manage, and restrict access to the Services for any violation of these terms.

16. PRIVACY POLICY

Please refer to our Privacy Policy to understand how we collect, use, and protect your personal data.

17. COPYRIGHT VIOLATIONS

If you believe any content on 99Plus infringes on your intellectual property rights, please notify us immediately.

18. TERM AND TERMINATION

These terms remain in effect while you use 99Plus. We reserve the right to terminate or suspend your account for violations of these terms.

19. MODIFICATIONS AND DOWNTIME

We may modify or discontinue parts of the Services at any time. We are not liable for any interruptions in service.

20. GOVERNING LAW

These terms are governed by the laws of Sri Lanka, without regard to conflict of law principles.

21. DISPUTE RESOLUTION

Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of Sri Lanka.

22. ERRORS AND CORRECTIONS

We do not guarantee the accuracy, completeness, or timeliness of any information provided through the Services. There may be typographical errors, inaccuracies, or omissions, including descriptions, pricing, or availability. We reserve the right to correct any errors and to make changes or updates to the information on the Services at any time without prior notice.

You acknowledge that we are not liable for any inaccuracies or errors in the data, content, or information provided through the Services.

99Plus is provided on an "as-is" basis. We make no warranties or representations regarding the accuracy or availability of the Services.

24. LIMITATION OF LIABILITY

We are not liable for any damages or losses arising from your use of the Services, except as required by law.

25. INDEMNITY

You agree to indemnify and hold us harmless from any claims or damages arising from your use of 99Plus or violation of these terms.

26. USER DATA

We may store data related to your use of the Services. You are responsible for maintaining backups of any data you submit to the Services.

27. ELECTRONIC AGREEMENTS

By using 99Plus, you agree to receive communications from us electronically and accept that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

28. OTHER PROVISIONS

These terms, together with our Privacy Policy, represent the entire agreement between you and us. Any failure by us to enforce any right or provision will not constitute a waiver of that right or provision.
